NOTES TO QUESTION 1A (SURFACE AND UNDERGROUND)
1) CT: Mining is regulated by the individual towns, not the state.
2) DE: No state mining legislation. Sand and gravel is only commodity mined. County zoning requirements are sole legislation.
3) HI: No noncoal mining activity except sand and gravel quarry operations. No state mining regulation.
4) IA: There are no actual Federal or Indian lands.
5) NE: The only noncoal solid mineral in the state is sand and gravel leasing.
6) NJ: No active underground mining at this time.
7) ND: Although no state agency regulates sand, gravel and scoria mining in North Dakota, state law requires these mine operators to file an annual report with the State Soil Conservation Committee on their mining activities. The report includes the tonnage or cubic yards mined and acreages that were disturbed and reclaimed. Reclamation of the affected lands must be carried out according to a reclamation plan agreed to by the landowner and mine operator. If the agreed to reclamation work is not completed, the law allows the landowner to sue the mine operator for damages.
8) OH: The Division of Mineral Resources Management has five program areas, Abandoned Mine Lands (AML), Coal Regulatory, Industrial Minerals (IM), Mine Safety (MS) and Oil/Gas (O/G). Underground mining is regulated by the MS section in all the land of Ohio for miner health and safety. Ohio does not have an environmental function in the IM section related to mining underground. Note there are no Indian Lands being mined in Ohio, either surface or underground.
9) SD: Has a state mining program that operates under authority of state law. Mining is also regulated through federally delegated programs such as NPDES, Air Quality, etc.
10) VT: The only mineral presently mined is talc. Other quarry operations are granite, marble, slate, crushed rock, and sand and gravel. Due to the broad-based nature of Act 250 (land use and development law), the number of departments, agencies and towns involved in the permitting process, and the lack of extensive mining activity, the majority of the questionnaire cannot be answered clearly or accurately.
