NOTES TO QUESTIONS 17a-b:
1)AL: Surface Mining Reclamation Fund consisting of forfeited bond proceeds. Act 99-579, effective 10/1/99, authorizes the Director to establish and carry out a systematic schedule of reclamation of affected lands. However, bond fund totals only $225,000 for 270 sites abandoned.
2)CA: Chapter 15 regulations for active mines sometimes are applied.
3)CA: Source: EPA 319 grants money collected as fines.
4)CO: Source: Gaming taxes; non-point source funds.
5)LA: Source: 8 cent per ton regulatory fee on coal.
6)MD: Source: Reclamation fund supported by one time fee of $30/acre.
7)NV: Source: Fees: $1.00 per mining claim recordation. Assessment: $20 per acre on an approved Federal Plan of operating.
8)NM: Source: Penalties.
9)OH: 17A: State program funds through coal law; 17C: Priority ones are funded at Governor's discretion; 17D: Source: Portion of severance tax collected on non-coal minerals.
10)OR: We have the authority to develop one but there is no budget.
11)OR: On a project-by-project basis we have accomplished some AML reclamation.
12)PA: Limited to forfeited sites.
13)PA: Special fund established by legislation and supported by fees and civil penalties.
14)TX: Source: Certain application fees.
15)VA: Source: No state funds available. Orphaned Land Program (AML) is funded by interest earned on the operator deposits in the Minerals Reclamation Fund (pool bond). These funds are leveraged when appropriate by use of grants or gifts from others (landowners, other agencies, federal programs).
